As the buyer, you are taking on the tax liability that follows the land. Should you not remain in compliance of the farm & ag program, you will be liable upon removal for up to 7 years of compensating taxes, interest, and penalties.
As the Seller, it is your responsibility to provide income proof for 3 of the last 5 years for compliance prior to the continuation being approved for the Buyer. Acceptable forms of income proof are found in the Seller - Farm & Ag Use Plan. If compliance is not met, the continuation will not be granted, and the property removed from classification with compensating taxes, interest, and penalty owing prior to transfer of ownership.
