"Determination of Legal Availability" (DOLA) reviews will be required for all building permit applications proposing water supplies from permit exempt wells. The DOLA applies to all such building permit applications received on, or after January 2, 2018. A fee of $150.00 will be collected to offset the costs associated with the review and determination provided by Spokane County Department of Environmental Services.
Background:
To further implement the court's decision in Hirst v. Whatcom County, the Board of County Commissioners repealed the Interim Zoning Ordinance (Resolution 17-0537) at their regular afternoon meeting December 12, 2017. Resolution 17-1066 replaces the previous IZO language recognizing that under Hirst, counties were assigned t he responsibility of determining if water is legally available when a building proposes the use of a permit exempt well to supply water for domestic use (19.27.097 RCW), and provides for the Determination of Legal Availability requirement and collection of the associated fee.
